Without the AG's memo I think that local government officials could decline to give out marriage licenses to same sex couples as long as another employee is available to provide the license to the same sex couple. This is because they are not, in that capacity, acting on their own or another individual's behalf, but on the behalf over the government itself (at whatever level.) The performance of their duty is a public act and may not take any cognizance of individual religious preference because that government can have none itself and that of the government's agent (the public employee) does not apply, since the act is not theirs in any legal or constitutional sense
